Terms of Service

These terms govern your use of sortermarket. Please read them before you create an account, publish a listing or contact another trader. If you do not agree with them, do not use the platform.

1. Who we are

sortermarket is a business-to-business marketplace for bulk used clothing and textiles. It is operated by DIW Solutions FZ LLC. In these terms, "we", "us" and "our" mean DIW Solutions FZ LLC, and "you" means the person or business using the platform.

Our registered address is FDRK8726, Compass Building, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates.

2. Your agreement with us

By creating an account or using sortermarket, you accept these terms. If you are using the platform for a business, you accept them on that business's behalf.

These terms apply together with our Privacy Policy, our Acceptable Use and Prohibited Items policy, our Cookie Policy, and — if you subscribe to a seller plan — our Subscription, Refund and Cancellation Policy. Where a specific policy covers a topic, that policy applies to it.

3. Who may use the platform

sortermarket is for business use. You may use it only if you are trading in the course of a business, and only if you are at least 18 years old. It is not intended for consumers buying for personal use.

If you create an account for a company, you confirm that you are authorised to enter into these terms on its behalf and to act for it on the platform.

4. Your account

You need an account to publish listings, contact sellers or save lots. Browsing is open without one.

You must give accurate information when you register, and keep it up to date. This matters more here than on most platforms, because other traders decide whether to deal with you based on what your account says.

You are responsible for keeping your password secure and for everything done through your account. Tell us straight away if you think someone else has access to it.

Do not create multiple accounts to work around a limit, a suspension or a plan allowance.

5. What sortermarket is, and what it is not

sortermarket is a venue. We publish listings, we let buyers and sellers find and message each other, and we run the account, verification and reputation features described in these terms. That is the whole of what we do.

We are not a party to any trade agreed on or through the platform. Any sale is a contract between the buyer and the seller directly, on whatever terms they agree between themselves. In particular, we are not involved in:

  • negotiating or agreeing the price, quantity, grade or specification of any lot;
  • holding, transferring, escrowing or otherwise handling payment between a buyer and a seller;
  • inspecting, testing, grading, weighing or verifying any goods;
  • arranging, insuring, tracking or clearing carriage, export or import;
  • resolving a dispute about a trade, or enforcing what either party promised the other.

You are responsible for your own due diligence. Satisfy yourself about the other party, the goods, the payment method and the shipping arrangements before you commit to anything. Nothing on the platform is a recommendation to deal with a particular trader.

6. Listings

If you publish a listing, it is yours. You are responsible for its content and for the goods it describes.

Describe what you actually hold. Grade, composition, origin, weight and price must be accurate, and photographs must be of the lot you are offering. Our Acceptable Use and Prohibited Items policy sets out what may and may not be listed.

You confirm that you own the goods you list, or are authorised to sell them, and that selling them is lawful where you are.

Listings run for a fixed period and then expire. You can renew a listing, subject to the live listing allowance on your plan. We may remove a listing that breaches these terms or our Acceptable Use policy.

7. Buying

Buyers contact sellers through the platform's messaging. Everything after that — price, payment, inspection, collection and delivery — is agreed between the two of you directly.

Because we are not a party to your trade, we cannot guarantee that goods will be as described, that a shipment will arrive, or that either side will do what they promised. Agree your own terms, and use payment and shipping arrangements you are comfortable with.

8. Verification and the verified badge

Accounts can complete verification steps: confirming an email address and a phone number, and confirming a name or business name against an identity document through our verification provider.

A verified badge means those checks were completed and were passing when the badge was displayed. It is a statement about identity, and nothing more.

A verified badge is not an endorsement, a credit check, a quality assurance, or a guarantee that a trader will perform. Do not treat it as one. Verification status can also be withdrawn — for example, if an account changes the name it previously proved.

9. Reviews and reports

Traders who have been in contact through the platform can leave reviews. Reviews must be honest and based on your own experience. Do not write, buy or solicit fake reviews, and do not use a review to publish someone's personal details.

You can report a listing, a message or an account. Please report anything that breaches our Acceptable Use and Prohibited Items policy.

We review reports and may remove content or restrict an account. We do not promise a particular outcome or a particular timescale, and we may act on a breach whether or not anyone reported it.

10. Fees

Browsing listings and creating an account are free.

What it costs to publish listings, how it is billed, and how to cancel or get a refund are set out in our Subscription, Refund and Cancellation Policy. We do not charge commission on trades, because we are not part of them.

11. Content you post

You keep ownership of the listings, photographs, messages and other content you post.

You give us permission to host, store, reproduce and display that content so we can run the platform — for example, showing your listing in search results, resizing your photographs, and including your listing in our sitemap. This permission lasts as long as we need it for those purposes, and ends when the content is removed, except where we must keep a copy for the reasons set out in our Privacy Policy.

Everything else — the sortermarket name, logo, software, design and category structure — belongs to us or our licensors. Do not copy or reuse it without our permission.

12. Acceptable use

Our Acceptable Use and Prohibited Items policy forms part of these terms and sets out what you may not do on the platform and what may not be listed. Please read it — for this trade in particular, it covers hygiene, contamination and import restrictions that a general policy would not.

13. Suspension and removal

We may remove content, suspend an account or close an account if these terms or our Acceptable Use policy are breached, if we are required to by law, or if we reasonably believe it is necessary to protect other traders or the platform.

Where it is reasonable to do so, we will tell you why. A suspension does not entitle you to a refund of a seller plan for a period during which the suspension was your own breach.

You can close your account at any time. Closing it does not automatically cancel a seller plan — see the Subscription, Refund and Cancellation Policy for how to cancel.

14. Availability

We work to keep the platform available, but we do not guarantee that it will be uninterrupted or error-free. We may need to take it down for maintenance.

We may add, change or remove features. If we remove a feature that a paid plan was sold on, the Subscription, Refund and Cancellation Policy explains what happens.

15. Disclaimers

The platform is provided as it is. We make no promises about the goods listed on it, the traders using it, or the outcome of any dealing between them.

To the extent the law allows, we exclude all warranties, conditions and terms that are not expressly set out in these terms.

16. Our liability

We are not liable for loss arising out of a trade between you and another user — including goods that are not as described, non-payment, non-delivery, losses in transit, customs seizure, or a trader who does not perform. That follows from what the platform is: we are a venue, not a party.

Where we are liable to you, our total liability for all claims in any twelve-month period is limited to the amount you paid us in seller plan fees in that period, or one hundred US dollars if you paid us nothing.

Nothing in these terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by our negligence, or for fraud.

17. Indemnity

If a claim is brought against us because of something you listed, sent or did on the platform, or because you breached these terms or the law, you agree to cover the losses, damages and reasonable costs we incur as a result.

18. Changes to these terms

We may update these terms. When we do, we will change the effective date at the top of this page, and we will give notice of any significant change through the platform or by email.

If you keep using the platform after a change takes effect, you accept the updated terms. If you do not accept them, stop using the platform and, if you hold a seller plan, cancel it.

19. Governing law

These terms, and any dispute arising out of them or out of your use of the platform, are governed by the laws applicable in Ras Al Khaimah, United Arab Emirates.

The courts of Ras Al Khaimah, United Arab Emirates have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property in any court that has jurisdiction.

20. Contact
